A BILL

To amend the Clean Air Act to ensure reasonable emissions standards for highway motorcycles, and for other purposes.

1      Be it enacted by the Senate and House of Representa-
2  tives of the United States of America in Congress assembled,
Section 1. Short Title.
4  This Act may be cited as the "Motorcycle and
5  Motorcycling Small Business Protection Act."

SEC.2. AMENDMENTS TO THE CLEAN AIR ACT REGARDING
2      MOTORCYCLES
3      (a) STANDARDS. -- Section 202 of the Clean Air Act
4  (42 U.S.C. 7521) is amended--
5                (1) in subsection (a)(3), by amending subpara-
6      graph (E) to read as follows:
7      "(E) REVISED STANDARDS FOR HIGHWAY MOTOR-
CYCLES. -- Effective for the model year 2004 and there-
9  after, the regulations under paragraph (1) applicable to
10  emissions of nonmethane hydrocarbons from gasoline-
11  fueled highway motorcycles shall contain standards pro-
12  viding that such emissions shall not exceed 2.4 grams of
13  nonmethane hydrocarbons per kilometer." and
14               (2) in paragraph (2) of subsection (1), by strik-
15      ing "motor vehicles and motor vehicle fuels" and in-
16      serting "motor vehicles (other than highway motor-
17      cycles) and motor vehicle fuels".
18      (b) PROHIBITIONS. -- Section 203(a)(3) of the Clean
19  Air Act (42 U.S.C. 7522(a)(3)) is amended in subpara-
20  graphs (A) and (B) by striking "motor vehicle or motor
21  vehicle engine" each place such term appears and insert-
22  ing "motor vehicle (other than a highway motorcycle) or
23  motor vehicle engine".
24      (c) STATE STANDARDS. -- Section 209(b) of the Clean
25  Air Act (42 U.S.C. 7543(b)) is amended--

1                (1) in paragraph (1), by striking "The Admini-
2      strator shall" and inserting "Subject to paragraph
3      (4), the Administrator shall";
4                (2) in paragraph (3), by striking "in the case"
5      and inserting "In the case"; and
6                (3) by adding at the end the following:
7               "(4) The Administrator may not waive application of
8  this section with respect to any standard relating to the
9  control of emissions from highway motorcycles."
